Terms of Service

1. Acceptance of Terms

By using Photostudio.io, you agree to these terms and to our Privacy Policy. If you do not agree, do not use our service.

2. Service Description

Photostudio.io provides AI-powered product photography (ghost mannequin, on-model, lifestyle, flatlay, video, etc.). We reserve the right to modify or discontinue the service with reasonable notice.

3. Intellectual Property on Generated Images

Subject to full payment for the credits or subscription used, you receive a non-exclusive license to use the images generated through our service for commercial purposes. Ownership of the generated images is assigned to you once payment is complete. You retain all rights to your source images (e.g., garment photos) that you upload. We do not claim ownership of your inputs or outputs beyond what is necessary to operate the service.

4. Account and Payment

You are responsible for maintaining account security. Subscription and one-time purchases are subject to our pricing at the time of purchase. Payments are processed via Stripe. See our refund policy below.

5. Refund Policy

We follow Stripe's standard refund process. For digital services, refunds may be considered within 14 days of purchase on a case-by-case basis, especially if the service was not delivered or there was a technical failure on our side. Contact peter@photostudio.io to request a refund.

6. Uptime and Availability

We strive for high availability but do not guarantee specific uptime unless a separate Enterprise SLA applies. Scheduled maintenance will be communicated where reasonably possible.

7. Limitation of Liability

To the maximum extent permitted by law, Photostudio.io (11380 BV) and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

8. Acceptable Use

You may not use the service for illegal content, infringement of intellectual property, or to harm others. Generated images are intended for commercial use per your subscription tier. You must not upload content you do not have the right to use.

9. Data Processing

Our processing of your personal data is described in our Privacy Policy. For B2B customers acting as data controllers, we offer a Data Processing Agreement (DPA).

10. Governing Law

These terms are governed by Belgian law. Any disputes shall be subject to the courts of Belgium.
